Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of the StaffHawkmobile application and web dashboard (collectively, the “Service”), operated by Amzint(“we”, “us”, or “our”), a business based in New South Wales, Australia.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

StaffHawk is a workforce management platform that enables businesses (“Employers”) to schedule jobs, assign workers, track attendance via GPS-verified check-in and check-out, and generate invoices and payroll records. Workers (“Employees”) use the mobile application to accept shift assignments and record their attendance.

3. Accounts and Eligibility

  • You must be at least 18 years of age to use the Service.
  • You may create an account using an email address and password, or by signing in with Google or Apple. By using a third-party sign-in method, you authorise us to receive your name and email address from that provider to create or link your account.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You agree to provide accurate and complete information when creating your account and to keep it up to date.
  • You must notify us immediately at support@staffhawk.com.au if you become aware of any unauthorised use of your account.

4. Device Permissions

The mobile application requires the following device permissions to function:

  • Location (while using the app): Required to verify you are at the job site when checking in or out. Location is accessed only when you actively initiate a check-in or check-out - not in the background.
  • Camera: Required to take a verification photo at check-in and check-out. The camera is accessed only when you initiate these actions.
  • Push notifications: Used to notify you of shift assignments and send reminders before your shift starts. You may disable notifications in your device settings, but you may miss important shift information.

5. Employer Responsibilities

If you use the Service as an Employer, you agree that:

  • You will only assign workers who have consented to being tracked via GPS and photographed for attendance verification purposes.
  • You are responsible for ensuring your use of the Service complies with all applicable Australian employment laws, including the Fair Work Act 2009 (Cth) and relevant Modern Awards.
  • Attendance data, hours worked, invoices, and payroll records generated by the Service are provided as a record-keeping aid. You remain responsible for verifying the accuracy of all payroll and billing information before making payments or issuing invoices.
  • You will not use the Service to monitor workers outside of their agreed working hours or job site boundaries.

6. Worker (Employee) Responsibilities

If you use the Service as a Worker, you agree that:

  • You will only check in and out when you are genuinely at the job site and within your assigned shift hours.
  • You consent to your GPS location being recorded at the time of check-in and check-out and shared with your employer.
  • You consent to photos taken during check-in and check-out being stored and shared with your employer for verification purposes.
  • Attempting to falsify check-in records, GPS data, or photos constitutes a material breach of these Terms and may result in account suspension.

7. Acceptable Use

You must not:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the Service or its related systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Upload or transmit any content that is unlawful, defamatory, harassing, or infringes the intellectual property rights of any third party
  • Reverse engineer, decompile, or attempt to extract the source code of the Service

8. Intellectual Property

All intellectual property rights in the Service, including the software, design, and content, are owned by Amzint or our licensors. Nothing in these Terms grants you any rights in our intellectual property other than the limited right to use the Service as permitted by these Terms.

9. Third-Party Services

The Service integrates with third-party services. Your use of any third-party service is governed by that service's own terms and privacy policy:

  • Google LLC - Google Sign-In (authentication), Google Cloud Platform (infrastructure and file storage), and Google Maps and Places API (address search). Governed by Google's Terms of Service.
  • Apple Inc. - Sign in with Apple (authentication). Governed by Apple's Terms of Service.
  • Xero Limited - invoicing integration and, where enabled by the Employer, Xero Payroll for timesheet submission. Governed by Xero's Terms of Use.
  • Expo / Expo Push Notification Service - delivery of push notifications to your device.
  • Brevo (Sendinblue SAS) - transactional email delivery (account verification, payslips, invoices).
  • Sentry (Functional Software, Inc.) - error monitoring and crash reporting to help us maintain service reliability.

We are not responsible for the practices of third-party services. Your use of any third-party service is also subject to that service's own terms and privacy policy.

10. Account Deletion

You may delete your account at any time from within the app (Profile → Delete Account) or by contacting us at support@staffhawk.com.au. Upon deletion, your personal information (name, email, photo, and credentials) will be removed or de-identified immediately. Attendance and shift records associated with your account will remain visible to Employers as “Deleted User” to preserve their operational records, but will no longer be linked to your identity. Financial records may be retained where required by Australian taxation law.

11. Limitation of Liability

To the maximum extent permitted by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) and other applicable law:

  • The Service is provided “as is” without warranty of any kind, express or implied.
  • We are not liable for any indirect, incidental, special, or consequential loss or damage arising from your use of the Service, including but not limited to loss of income, data, or business opportunity.
  • Our total liability to you for any claim arising from these Terms or the Service will not exceed the amount you paid us in the 12 months preceding the claim.

Consumer guarantees: Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.

12. Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms or if we reasonably believe your use poses a risk to the Service or other users. You may close your account at any time from within the app or by contacting us at support@staffhawk.com.au.

13. Fees and Subscriptions

StaffHawk is currently provided free of charge. We reserve the right to introduce paid plans or subscription tiers in the future. If we do so, we will provide at least 30 days' notice via email or an in-app notification before any fees take effect. Continued use of the Service after that date will constitute acceptance of the applicable pricing. Free features available at the time of your registration will be clearly communicated if they become part of a paid tier.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notification at least 14 days before the changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising out of or in connection with these Terms or the Service.
